THE NOCKAMIXON SAIL CLUB IS CHARTERED TO PROMOTE THE SPORT OF SAILING BY ORGANIZING AND CONDUCTING SAILBOAT RACING, CRUISING, AND RELATED SAILING AND SOCIAL ACTIVITIES, AT, OR NEAR, LAKE NOCKAMIXON IN THE NOCKAMIXON STATE PARK IN BUCKS COUNTY PENNSYLVANIA.

 

THE CLUB MEETS TO CONDUCT BUSINESS AT CONVENIENT LOCAL FACILITIES DURING THE WINTER MONTHS, AND AT THE LAKE AS PART OF THE SKIPPERS MEETINGS, OR SOCIAL ACTIVITIES, DURING THE SAILING SEASON. NOTICE OF MEETINGS AND THE CONDUCT OF CLUB BUSINESS IS IN ACCORDANCE WITH THIS CONSTITUTION AND THESE BY-LAWS.

CONSTITUTION

ARTICLE I NAME

The name of this organization shall be the Nockamixon Sail Club, Incorporated (hereinafter “NSC”).

ARTICLE II OBJECTIVES

The objectives of NSC shall be: (a) to promote the sport of sailboat racing at Lake Nockamixon and elsewhere; (b) to organize and conduct friendly competition and other activities related to sailing and boating at the Lake; (c) to conduct social activities for the benefit of its membership; (d) to foster good will and interest in safe boating and sailing among the Membership and the community; and (e) to cooperate with any other organization in the promotion of the sport of sailing at Lake Nockamixon and elsewhere.

ARTICLE III MEMBERSHIP

The membership of NSC shall consist of Active Racing Members, Active Cruising Members, and Honorary Members who are all expected to promote the objectives of NSC and to assist in the activities and operation of NSC when called upon by the Officers.

ARTICLE IV OFFICERS

Section 1 The Officers of NSC shall consist of a Commodore, Vice-Commodore, Rear Commodore of Racing, Rear Commodore of Cruising, Quartermaster, Treasurer, Communications Officer, and Membership Secretary.

Section 2 NSC Officers shall be elected and installed at the November General Meeting by a majority vote of the Active Membership present and voting in proportion to the dues paid (Racing Dues = 1). All Officers shall serve for one (1) year, or until their successors are duly elected.

Section 3 Vacancies of the Officers of NSC caused by death, resignation, or otherwise, may be filled for the unexpired term at any Fleet Council Meeting by a majority vote of the Council.

Section 4 The duties, powers and privileges of NSC Officers shall be as provided for in the By- Laws.

Section 5 NSC Officers may serve multiple consecutive terms provided that they are duly elected each year at the November General Meeting.

Section 6 No NSC Member shall hold more than one (1) elected office in the Club at the same time.

ARTICLE V ADMIRALTY

Section 1 The NSC Admiralty shall consist of two (2) Members elected from the Active Racing Membership, two (2) Members from the Acting Cruising Membership, and of one (1) appointed Member from each NSC Fleet. The previous Commodore shall be an Ex-Officio, Voting Member of the Admiralty for the year following the term served as Commodore.

Section 2 Members of the Admiralty shall be elected, and installed, at the November General Meeting and shall serve for two (2) years or until their successors are duly elected. Two (2) Members, one Racing and one Cruising, shall be elected each year so that the terms of service are staggered.

Section 3 In addition to the four (4) elected Admiralty members, each NSC Fleet Captain shall serve, or appoint an Active Member from their Fleet to serve, on the Admiralty for one (1) year.

Section 4 Both the elected and appointed Members of the Admiralty shall vote on Admiralty and Fleet Council business, but no proxies shall be accepted from Admiralty members absent at Fleet Council meetings.

Section 5 Vacancies in the Admiralty caused by death, resignation, or otherwise, shall be filled for the unexpired term by appointment by the Commodore upon approval of the Fleet Council for Elected Members, and by appointment by the respective Fleet Captains for Appointed Fleet Members.

Section 6 The Chairperson of the Admiralty, who shall be one (1) of the four (4) elected Members, shall be elected by the Members of the Admiralty.

Section 7 Active Members of the Admiralty may serve multiple consecutive terms provided that they are duly elected, or appointed, to serve further terms at the November General Meeting.

ARTICLE VI FLEET CAPTAINS

Section l NSC Fleet Captains shall be elected as provided for in the rules of that Fleet.

Section 2 Vacancies in any NSC Fleet Captain position caused by death, resignation, or otherwise, shall be filled for the unexpired term by action of the Members of that Fleet.

ARTICLE VII FLEET COUNCIL

Section 1 The NSC Fleet Council shall consist of the duly elected Officers and Admiralty and the elected Fleet Captains, or their appointed Fleet representatives. The previous Commodore shall be an Ex Officio Voting Member of the Fleet Council for the year following the term served as Commodore.

Section 2 The powers and duties of the Fleet Council shall be as provided for in the NSC By- Laws.

ARTICLE VIII STANDING COMMITTEES

Section 1 The Standing Committees of NSC may consist of the following: (a) Education & Training, (b) Fund Raising, (c) Membership, (d) Communications, (e) Racing, (f) NSC Property, (g) Social, and (h) Web Site.

(The Budget Committee shall consist of the Treasurer, acting as Chairman, the Commodore, the Quartermaster, the Membership Secretary, and two of the Elected members of the Admiralty who shall be appointed by the Commodore as provided for in Article VI (c) of the By-Laws.)

Section 2 The Commodore shall annually appoint, subject to the approval of Fleet Council, Chairpersons of appropriate Standing Committees who may serve as individuals to provide the desired function, or serve with an appointed Committee membership.

Section 3 Additional Committees, as deemed necessary or desirable by the Commodore or the Fleet Council, to promote the programs and activities of NSC, may be established at any time by the Fleet Council.

Section 4 Members of all NSC Committees shall be selected from among the Active Members by the Commodore. The Commodore may delegate or partially delegate the authority of appointment to Committee Chairpersons. The Chairpersons and Committee Members shall serve for one (1) year, or until their successors are appointed.

Section 5 The functions and duties of the various Standing Committees shall be as provided for in the NSC By-Laws.

ARTICLE IX MEETINGS

Section 1 At least one General Meeting of NSC shall be held annually, typically in November, for the conduct NSC business and the election of Officers for the following year. The November General Meeting shall be publicized by at least thirty (30) days notice in the NSC Newsletter, or by mail, to all Active Members. Other NSC General Meetings may be held in addition to the November General Meeting. If so, other General Meetings shall be held at a time and place designated by the Fleet Council and publicized by at least thirty (30) days advance notice in the NSC Newsletter, or by mail, to all Active Members. In an emergency, the Commodore or Vice Commodore shall determine the time and place.

Section 2 NSC Fleet Council meetings shall be open to any Member and may be held at a frequency, time, and place designated by the Council and publicized by at least fourteen (14) days notice in the Newsletter, or by mail, to all Active Members. Other methods for Notification of a Fleet Council meeting, for example e-mail or telephone, with fourteen (14) days notice, to the members of the Fleet Council and Admiralty, may be used at the discretion of the Commodore. Location, date, and time of a previously publicized Fleet Council meeting may be changed by the Commodore, and publicized by any reasonable method in case of emergency.

Section 3 Special Meetings of NSC may be called by the Commodore, at the Commodore’s discretion, or upon the written request of seven (7) Active Members to the Commodore, but no business shall be transacted other than that for which the Special Meeting is called. Notification of Special Meetings shall be made at least thirty (30) days in advance in the Newsletter, or by mail, to all Active Members.

Section 4 Twenty percent (20%) of the Active Membership, and six (6) Members of the Fleet Council, shall constitute a quorum for the transaction of business at a General Meeting of NSC. Ten percent (10%) of the Active Membership, and six (6) Members of the Fleet Council, shall constitute a quorum for the transaction of business at a Special Meeting of NSC. Six (6) Members of the Fleet Council shall constitute a quorum for the transaction of business at a NSC Fleet Council Meeting.

Section 5 Proxies shall be permitted at any of the meetings for voting or for the transaction of any business. Proxies from absent Members shall be in writing, signed, and assigned to an Active Member of the Club in attendance at the Meeting. No more than one proxy may be held by each Active Member in attendance at the Meeting and the proxy shall be presented to the Membership Secretary.

Section 6 Any NSC Meeting may be scheduled during the sailing season to be held at the Lake during a social activity, or at a skippers meeting, provided that the requirements for Notification and Quorum are in accordance with this NSC Constitution.

ARTICLE X AMENDMENTS

This Constitution may be amended by a two thirds majority vote of the Active Membership at any General Meeting of NSC, provided that the proposed amendments have been previously reviewed by the Fleet Council and that copies have been sent to Active Members of the Club at least two (2) weeks in advance of the meeting.

 

 

BY LAWS

ARTICLE I MEMBERSHIP

Section 1 Any person desiring to become an Active Racing Member, or Active Cruising Member, of NSC shall submit an application annually, accompanied by the proper Annual Dues. Membership may be renewed annually by application accompanied by the proper Dues.

Section 2 An Active Racing Membership shall include all Members of a given household – but shall have only one (1) vote.

Section 3 An Active Cruising Membership shall include all Members of a given household – but shall have only a fractional vote proportional to the dues paid (Racing Dues = 1).

Section 4 All Elected Officers, Admiralty, and Fleet Captains, shall have an equal vote at all Fleet Council and Committee Meetings.

ARTICLE II HONORARY MEMBERSHIP

Section 1 Honorary Membership may be conferred on any person who has been recommended by the Fleet Council for his dedication and contributions to NSC by a three fourths vote of the Active Membership present at any NSC General Meeting. Honorary Membership shall automatically be granted to all past Commodores when they cease to be Active Members. Honorary membership shall also be extended to the current State Park management.

Section 2 Honorary Members are not required to pay dues, and are not eligible to vote or hold elected positions in NSC or in any Fleet. They shall receive all NSC communications distributed to Members.

ARTICLE III DUTIES OF FLEET COUNCIL OFFICERS

Section 1 The Commodore shall:

(a) Preside over all Meetings of NSC.

(b) Appoint the Chairpersons, or individual Members to perform the functions, of all NSC Committees.

(c) Be an Ex Officio Voting Member of all Committees.

(d) Perform all other functions usually attributed to this Office.

(e) Be a member of the Budget Committee.

(f) Report annually, or as requested, to the State to maintain the status of NSC Incorporation.

Section 2 The Vice Commodore shall:

(a) Assume the duties of the Commodore in the Commodore’s absence.

(b) Be responsible for the non racing activities and the General Meetings of NSC.

(c) Function as, or be a Member of, the Social Committee.

(d) Perform such duties as may be delegated by the Commodore.

(e) Have charge of NSC property related to social activities.

Section 3 The Rear Commodore of Racing shall:

(a) Be responsible for all racing activities of NSC.

(b) Function as, or be a Member of, the Racing Committee.

(c) Revise and Issue the NSC Sailing Instructions.

(d) Organize the Race Committee Duty Roster and issue R/C operating instructions.

(e) Function as, or appoint, a Scorekeeper to provide the NSC race results to the Fleet Captains.

(f) Perform all the duties of the Commodore during the absence of both the Commodore and the Vice Commodore.

(g) Function as, or be, the Captain of the Portsmouth Fleet in the absence of an elected Fleet Captain.

Section 4 The Rear Commodore of Cruising shall:

(a) Be responsible for all cruising activities of NSC.

(b) Be a Member of, the Social Committee.

(c) Revise and Issue the NSC Cruising Calendar.

(d) Organize the activities and development of Fleets with common interests within the Active Cruising membership.

(e) Function as, or be, the Captain of any Cruising Fleet in the absence of an elected Fleet Captain.

Section 5 The Quartermaster shall:

(a) Have charge of all NSC property, except that related to social activities, and keep same in good order and repair.

(b) Function as, or be a Member of, the NSC Property Committee.

(c) Be a member of the Budget Committee.

Section 6 The Treasurer shall:

(a) Collect all dues, care for the funds of NSC, and keep accurate records of all transactions.

(b) Submit a report at each Fleet Council meeting to be included in the minutes.

(c) Close the NSC accounts on October 3lst and submit them for audit prior to, or at, the November General Meeting.

(d) Be a member of any Fund Raising Committee.

(e) At the end of the Treasurer’s term of office, deliver to the elected successor all the funds, books, papers, etc., in his possession which belong to NSC.

(f) Be the Chairman of the Budget Committee.

Section 7 The Communications Officer shall:

(a) Be responsible for editing and publishing a minimum of three (3) issues of the NSC Newsletter each year, and any other NSC publicity approved by the Fleet Council.

(b) Be responsible for all NSC publications, literature, articles, posters, stories for publication, etc., with the exception of the minutes of meetings.

(c) Function as, or be a member of, the Communications Committee.

(d) Be responsible for Notifying the Membership of NSC General and Special Meetings.

(e) Be responsible for the Web Site Committee.

Section 8 The Membership Secretary shall:

(a) Keep accurate minutes of all business meetings of NSC.

(b) Keep records of attendance of all General and Fleet Council Meetings.

(c) Maintain all records required for NSC Incorporation.

(d) Maintain a list of the NSC Membership in good standing.

(e) Be a member of the Budget Committee.

(f) Assist the Commodore in preparation of the Annual Summary Report of NSC activities for publication in the NSC Newsletter.

(g) Be a member of, or function as, the Membership Committee, maintain the Membership records, and provide the current Membership list to the Communications Officer for mailing of the Newsletter and Notices of Meetings.

ARTICLE IV DUTIES OF THE ADMIRALTY

The Admiralty shall:

(a) Audit the accounts and records of the Treasurer and render a report of these accounts and records to the Membership at the November General Meeting, and to the Fleet Council upon its request.

(b) Review all applications for Membership from previously expelled Members before the applicants are voted upon for Membership, and render a verbal report to the Fleet Council concerning its findings as to the desirability for reinstatement.

(c) Review all leases, contracts, deeds, insurance policies, and other legal papers and documents affecting NSC and pass upon their acceptability before any action is taken by NSC to change any such documents or policies.

(d) Serve as a Nominating Committee to select at least one (1) candidate for each Elected and Appointed Office. Candidates nominated shall have agreed to serve. The slate shall be presented at the November General Meeting and published in the next issue of the NSC Newsletter.

(e) Work, as requested, with the Commodore and Fleet Council to establish goals and guidelines for the year and present a written schedule of events for approval at the off-season Fleet Council meetings.

ARTICLE V DUTIES OF THE FLEET CAPTAINS

The Fleet Captains shall:

(a) Report to the appropriate Rear Commodore — Racing or Cruising.

(b) Organize and conduct Fleet activities that will further the goals and objectives of NSC.

(c) Coordinate Fleet schedules and planned activity through the NSC Fleet Council.

(d) Serve, or designate a Fleet representative to serve, in the NSC Admiralty.

(e) Provide the results of Fleet racing to the Web Site Committee, and to the Communications Officer as part of the Fleet Report for publication in the Newsletter.

ARTICLE VI DUTIES OF THE FLEET COUNCIL

The Fleet Council shall:

(a) Conduct the regular business of NSC at scheduled and publicized Fleet Council Meetings. Review major financial and policy matters of the Club, and prepare any recommendations for presentation to the Membership for official action at a General Meeting.

(b) Accept reports of all NSC Committees as requested by the Officer in charge, and, in turn, request that Committee reports be given to the Membership as deemed necessary.

(c) Act upon a budget report prepared by the Budget Committee, which shall consist of the Treasurer, the Quartermaster, the Secretary, and two (2) elected Members of the Admiralty, who shall be appointed by the Commodore.

(d) Review any proposed amendments to the NSC Constitution and By-Laws and recommend appropriate action.

ARTICLE VII STANDING COMMITTEE FUNCTIONS

The functions of the various NSC Standing Committees may be delegated by the Commodore to individual Members or Officers who may act with others as the Committee, or as individuals, to perform the functions. When activated, the functions of the Committees shall be as follows:

(a) The Education and Training Committee shall be responsible for planning and conducting basic, advanced, and junior sailing and racing programs and courses.

(b) The Fund Raising Committee shall be responsible for the NSC fund-raising activities, with the exception of Membership dues and racing fees.

(c) The Membership Committee shall be responsible for promoting NSC Membership and for Membership application processing. The Committee shall keep an accurate and up to date Membership list of all Active Memberships and Honorary Members of NSC and provide regular updates of the Membership to the Communications Officer.

(d) The Communications Committee shall be chaired by the Communications Officer and shall be responsible for the editing and publishing of the NSC Newsletter.

(e) The Racing Committee shall be responsible for the planning and scheduling of race series and of NSC Invitational Regattas, obtaining appropriate Regatta Trophies, obtaining any required permits, notification of rules, race management, protest hearings, and other racing activities.

(f) The NSC Property Committee shall be responsible for maintaining an approved inventory of items for sale to NSC Members (such as flags, T shirts, sweatshirts, books, etc.) and for maintaining a catalog of such gear and equipment.

(g) The Social Committee shall be responsible for all NSC social activities (such as cocktail parties, dinners, picnics, and awards banquets).

(h) The Web Site Committee shall be responsible for maintaining a NSC Web Site as a communication source for Members and other interested parties. The site should include general NSC information, schedules, results of racing activities, and links to related sailing subjects.

ARTICLE VIII MEETINGS

Section 1 The order of proceedings at the Fleet Council meetings shall be:

(a) Call to order;

(b) Reading, amendment, and approval of minutes of the previous meeting;

(c) Treasurer’s report;

(d) Reports of Officers and Committees;

(e) Elections;

(f) Old business;

(g) New business;

(h) Announcements;

(i) Adjournment.

Section 2 The order of proceedings at the General Meetings of the membership shall be:

(a) Call to order;

(b) Summary of Fleet Council meeting business items;

(c) Reports of Officers;

(d) Elections;

(e) Other business;

(f) Program;

(g) Adjournment.

Section 3 Any action of the Fleet Council can be recalled for review by the general membership upon request to the Commodore by three Active Members.

Section 4 The business portions of all meetings shall be conducted according to Robert’s Rules of Order.

ARTICLE IX DUES

Section 1 The amount of annual dues and initiation fees (if any) shall be determined by the Fleet Council after review of the recommendation of the Budget Committee. The Fleet Council may increase the annual dues once per year by up to 25% after review of the current financial situation.

Section 2 The Annual Dues for Memberships are due by March 1st of each year.

Section 3 Any Member not having paid their dues by March 31st shall have their Membership privileges rescinded.

Section 4 Any Members in arrears for dues on March 31st shall cease to be Members of NSC and all rights, title and interest in and to all the property and assets of NSC shall cease. Furthermore, a Member who has been thus expelled from NSC shall not be re elected to Membership except upon formal application and payment of all indebtedness and the proper Membership fees.

Section 5 Any former members who race before they have paid dues, or before being reinstated as members, shall not be scored in the NSC race records.

ARTICLE X FLEET OPERATIONS

A. For all NSC Fleets:

Section 1. NSC Fleets shall consist of boats of the designated Class, or Builder, or Type, or common interest. The minimum number of boats required to form any NSC Fleet shall be five (5). All Fleet boats must be owned by, or chartered by, NSC members.

Section 2. Fleets shall promote family, friendly, and fun activities (picnics, cruises, rigging clinics, safety seminars, etc.) to aid in the growth and goals of NSC, and shall conduct these activities under the umbrella of NSC and shall advise the NSC Fleet Council of plans and schedules.

Section 3. Non Members sailing regularly with any Fleet shall be encouraged to join that Fleet and NSC.

Section 4. Each NSC Fleet shall elect a Fleet Captain, Fleet Measurer, and a Fleet Treasurer, other Officers are optional. All Fleet Officers shall be Members of NSC. Fleet Officers shall be elected before the sailing season begins, typically at the Spring Warm-Up / General Meeting.

Section 5. The Fleet Measurer shall conduct periodic inspections of all Fleet boats to assure compliance with the current Class Rules, if any, especially safety considerations, and with the applicable State Park and US Coast Guard requirements.

Section 6. All Fleet monies collected by the Fleet Treasurer shall be recorded and banked outside the NSC Treasury. Fleet annual budgets shall be supplied to the NSC Fleet Council upon request. Each NSC Fleet shall fund its own Fleet activities and trophies.

Section 7. Perpetual trophies of all NSC Fleets shall remain the property of the NSC and shall be presented at the Annual NSC Awards Banquet / General Meeting.

Section 8. Fleet By-Laws shall be written and supplied to the NSC Fleet Council upon request. The responsibilities of each Fleet Officer will be defined by Fleet By-Laws.

Section 9. An Active Fleet Member shall be selected to compile and edit correspondence and/or news articles relating to Fleet activities for forwarding to the NSC Communications Officer.

Section 10. An Active Member of each Fleet shall be assigned to help the NSC Vice Commodore with the organization and logistics of NSC social events. An Active Member of each Fleet shall be assigned to help with NSC projects at the request of the Commodore.

Section 11. The NSC Rear Commodore of Racing, the NSC Rear Commodore of Cruising, and the assigned Fleet representatives, shall coordinate with the NSC Vice Commodore to organize the annual NSC ULDB Regatta and Picnic. NSC shall provide Awards for all participants, both Racing and Cruising, in this event.

B. Additionally for Racing Fleets:

Section 12. The Racing Fleet Measurer shall provide to the NSC Rear Commodore of Racing, upon request, copies of the current Class Rules, the local Fleet Rules, and the measurement certificates of Fleet boats.

Section 13. The Racing Fleet Captain shall provide to the NSC Rear Commodore of Racing, a list of Fleet Members and a list of members who can participate in a Protest Committee (at least one name for every five members). All active Racing Fleet Members shall be placed on the Race Committee Duty schedule by the Rear Commodore of Racing.

Section 14. The Fleet racing program shall be selected from the Racing Calendar supplied by the NSC Rear Commodore of Racing. Racing schedules shall be completed by the Spring Warm-Up / General Meeting of NSC.

Section 15. Racing Fleets may hold Regattas on days designated by the NSC Rear Commodore of Racing as Regatta Days. Holding a Regatta consists of the following:

(a) Race Organization and guidance

(b) Social Committee

(c) Racing

(d) Advertising the event

Section 16. A Portsmouth Fleet shall be formed to accommodate racing by any type of boat. The Portsmouth Fleet will ensure that there will be Fleet Racing on race days when there is no major NSC event, and independent of any Class Fleet participation. All Active Racing Members shall be entitled to sail in the Portsmouth Fleet, or in their Class Fleet, and may be scored in both when they start together. The Portsmouth Fleet shall elect officers from the Active Fleet Membership and function in a similar manner to a Class Fleet.

Section 17. As an exception to Section 6, above, NSC shall provide for trophies and/or commemorative items for the Portsmouth Fleet in an amount appropriate to the number of Fleet members to be approved annually by the Fleet Council.

Section 18. NSC shall provide Trophies for up to seven (7) NSC Invitational Regattas, top three places, in an amount to be approved annually by the Fleet Council.

Section 19. The NSC Perpetual Championship “Cup” Trophy shall be awarded to the skipper with the best series score from the NSC Invitational Regattas.  Trophies shall be provided to the top three series finishers.

Section 20. NSC shall organize a Frostbite Racing Series open to all NSC Fleet boats which all start at the same time. The dates shall be determined by the Rear Commodore of Racing and shall consist of up to 6 dates in the Spring and Fall. NSC shall provide trophies for the top three Series winners in an amount to be approved annually by the Fleet Council.

Section 21. The current edition of the US Sailing Portsmouth Yardstick handicap rating system, shall be used to score races in which different classes of boats participate.

C. Additionally for Cruising Fleets

Section 22. The NSC Cruising Fleet shall elect officers from the active Cruising Membership and function in a manner similar to a Class Fleet. The Rear Commodore of Cruising may appoint Fleet Captains as appropriate in the first year of newly forming Fleets. The Rear Commodore of Cruising may appoint Event Captains as appropriate.

Section 23. As an exception to Section 6, above, NSC shall provide for trophies and/or commemorative items for the Cruising Fleet Events in an amount appropriate to the number of Cruising Fleet members to be approved annually by the Fleet Council.

Section 24. NSC shall provide Trophies for up to eight (8) NSC Invitational Cruising Events, top three places, in an amount to be approved annually by the Fleet Council.

Section 25. The Cruising Fleet activity program shall be selected from the Cruising Calendar supplied by the NSC Rear Commodore of Cruising. Cruising Fleet event schedules shall be completed by the Spring Warm-Up / General Meeting of NSC.

Section 26. Cruising Fleet members may participate in all NSC Invitational Regattas, as guests.

Section 27. Cruising Fleets may hold Events on days designated by the NSC Rear Commodore of Cruising as Event Days. Holding an Event consists of the following:

(a) Event Organization and guidance

(b) Social Committee

(c) Event activity

(d) Advertising the event

ARTICLE XI EXPULSION OF MEMBERS

Section 1 Any Member may be expelled from NSC by a two thirds vote by secret ballot of the Active Membership for any act against NSC which may tend to its injury or loss of reputation.

Section 2 Expelled Members shall forfeit all interest in the property and assets of NSC.

Section 3 An expelled Member may reapply for Membership after one (1) year from the date of the expulsion. The expelled Member’s reapplication shall be reviewed by the Admiralty, and, if the Fleet Council approves, the expelled Member will be reinstated.

ARTICLE XII GENERAL HOUSE RULES

Section 1 Members inviting guests to NSC activities shall be responsible for their conduct at the activity. This includes anyone sailing with a member in a racing activity.

Section 2 All damage to NSC property shall be immediately reported to the Quartermaster or, in his absence, to any Officer; and proof shall be made to same that the cause thereof was accidental or unavoidable, or such person shall be personally responsible to the NSC for damages incurred.

Section 3 No member shall use NSC property without the expressed permission of either the Quartermaster or the Commodore. Members may hire NSC property with the approval of the Fleet Council.

ARTICLE XIII AMENDMENTS

The NSC By-Laws may be amended by a majority vote at any meeting of the Fleet Council provided that copies of the proposed amendment have been sent to members of the Council at least fourteen (14) days in advance of the meeting.

ARTICLE XIV ADOPTION

The Constitution of NSC, as presented and amended above, and with properly moved changes, shall go into effect upon a majority vote of the Active Members who are present and voting at the November 8th 2008 General Meeting. The By-Laws of NSC, as presented and amended above, and with properly moved changes, shall go into effect upon a majority vote of the Fleet Council who are present and voting at the January 2009 Fleet Council Meeting.

ARTICLE XV DISSOLUTION

In the event that NSC can no longer function as intended in Article II of its Constitution, all assets of the Club shall be provided to an organization with objectives similar to those in that Article, or, in the absence of such similar organization, shall be provided to the Manager of the Nockamixon State Park for use at his discretion for the benefit of all users of the Park.

THE CONSTITUTION AND BY-LAWS OF THE NOCKAMIXON SAIL CLUB WERE DRAFTED IN 1975, REFINED FOR INCORPORATION IN 1977, AND HAVE BEEN REVISED AND AMENDED PERIODICALLY, AS PROVIDED IN THE DOCUMENTS, TO ACCOMMODATE THE CHANGING NEEDS OF THE CLUB.

A 1981 REVISION ADOPTED THE CURRENT FORMAT WHICH WAS REVIEWED AND APPROVED BY THE MEMBERSHIP AT A GENERAL MEETING ON OCTOBER 20, 1981, AND PUBLISHED AS A CLUB PAMPHLET.

A 1986 REVISION WAS REVIEWED AND APPROVED BY THE FLEET COUNCIL AT MEETINGS IN JANUARY AND FEBRUARY OF 1986, APPROVED BY THE MEMBERSHIP AT A GENERAL MEETING OF NSC ON MARCH 16, 1986, AND PRINTED FOR DISTRIBUTION TO THE MEMBERSHIP..

A 2002 REVISION, THE FIRST ELECTRONIC VERSION, WAS REVIEWED AND APPROVED AT THE FLEET COUNCIL MEETING ON MARCH 6, 2002, AND REVIEWED AND APPROVED BY THE MEMBERSHIP AT A GENERAL MEETING OF NSC ON MARCH 23, 2002, FOR PRINTING AND DISTRIBUTION TO THE MEMBERSHIP. THIS REVISION, AND ALL SUBSEQUENT REVISIONS, HAVE ALSO BEEN SHOWN ON THE NSC WEB SITE.

A 2004 REVISION, TO ACCOMMODATE CRUISING MEMBERS, WAS REVIEWED AND APPROVED AT THE FLEET COUNCIL MEETINGS OF AUGUST 24, 2004 AND NOVEMBER 1, 2004, AND THEN BY THE MEMBERSHIP AT THE NSC ANNUAL GENERAL MEETING ON NOVEMBER 19, 2004, FOR PRINTING AND DISTRIBUTION TO THE MEMBERSHIP.

A 2008 REVISION, TO RECOGNIZE THE INCREASING ROLE OF THE CRUISING MEMBERS, AND REVISE THE CLASSES OF MEMBERSHIP, WAS REVIEWED AND APPROVED BY THE FLEET COUNCIL AT MEETINGS ON SEPTEMBER 22, 2008 AND OCTOBER 13, 2008, AND THEN APPROVED BY THE MEMBERSHIP AT THE NSC ANNUAL GENERAL MEETING ON NOVEMBER 8, 2008, AND SUPERSEDES ALL PREVIOUS REVISIONS.

A 2009 AMENDMENT OF ARTICLE X OF THE BY-LAWS, TO REDEFINE FLEET OPERATIONS AND INCLUDE CRUISING FLEETS, WAS APPROVED AT THE FLEET COUNCIL MEETINGS ON JANUARY 12, 2009, AND FEBRUARY 23, 2009, AND SUPERSEDES ALL PREVIOUS REVISIONS. THIS REVISION WAS PRINTED FOR DISTRIBUTION TO THE MEMBERSHIP IN 2010.

A 2011 AMENDMENT OF ARTICLE 1 OF THE BY-LAWS, TO DEFINE VOTING RIGHTS OF OFFICERS AND FLEET CAPTAINS AT FLEET COUNCIL MEETINGS, WAS APPROVED AT THE FLEET COUNCIL MEETING ON FEBRUARY 21, 2011.

A 2013 AMENDMENT OF SECTION 19 TO MAKE CLEAR THE SKIPPER IS BEING SCORED. WAS APPROVED BY FLEET COUNTIL ON JANUARY 14, 2013

A 2018 AMENDMENT OF ARTICLE X, SECTION 18 TO PROVIDE TROPHIES FOR UP TO SEVEN (7) NSC INVITATIONAL REGATTAS. AMENDMENT OF ARTICLE X, SECTION 19 TO ADD TROPHIES SHALL BE PROVIDED TO THE TOP THREE SERIES FINISHERS. WAS APPROVED BY FLEET COUNTIL ON MARCH 5, 2018
